ICT Regulations

​​This section is intended to inform Algerian companies on the new information and communications technology (ICT) regulations in Algeria in connection with the everyday management of their usual activities.

The ICTs regulations in Algeria contain legislative and regulatory texts:

 

Basic Texts

 

Texts governing the use of ICT by sector

  • Executive Decree No. 98-257 of 3 Jumada El Oula 1419 corresponding to 25 August 1998 defining the conditions and arrangements for setting up and operating of Internet services.
  • Decree No. 09-410 of 10 December 2009 laying down the safety rules applicable to activities relating to sensitive equipment

Texts on Electronic Signature

  • Law No. 05-10 of 20 June 2005 amending and supplementing Ordinance No. 75-58 on the civil code.

Electronic writing recognition as a means of proof.

Art.323 ter: The writing in electronic form is admissible as evidence in the same way as writing on paper, provided that the person from whom it originates can be duly identified and the document be drafted and recorded in conditions that guarantee its integrity.

  • Ordinance No. 75-58 of 26 September 1975, as amended and supplemented relating to the Civil Code.

    provides for the legal basis of the electronic signature in articles 323 to 327 bis of Ordinance No. 75-58 of 26 September 1975, as amended and supplemented (Part related to means of proof).
  • Ordinance No. 75-59 of 26 September 1975 and supplemented relating to commercial code.

    Acknowledges (part relating to commercial paper) in Articles 414 and 502 the introduction of electronic trading means  in the case of bill of exchange holders or physical presentation of a check.
  • Ordinance No. 66-155 of 8 June 1966, as amended and supplemented on the Code of Criminal Procedure.

    The articles 16 and 47 relate to the terms of prosecution and investigation on breaches of automated data processing system
  • Executive Decree No. 01-123 modified: attributing to the regulatory authority (ARPT) the issuance of the authorization for establishing and operating electronic certification services, accompanied by a specification
  • Executive Decree No. 07-162 of 30 May 2007 amending and supplementing Executive Decree No. 2001-123 of 9 May 2001 on the operating regime applicable to each type of network, including radio and various telecommunications services submitted to the electronic certification activity in the authorization regime..

 

E-governance

  • Law 05-02 of 16 February 2005 amending and supplementing Ordinance No. 75-59 of 26 September 1975 promulgation the Commercial Code.

    This Law introduced electronic trading in Articles 414-502.
  • Law No. 04-14 of 10 November 2004 amending and supplementing Ordinance No. 66-155 of 8 June 1966 promulgating the Criminal Procedure Code. 

    Instituting within the Ministry of Justice of computerized national judiciary records connected to the courts.
  • Law No. 08-04 of 23 January 2008 laying down framework law on national education.

    This Law referred to in Articles 2 and 4 to training in technology to fit into the knowledge society
